To whom it may concern,

This past weekend I purchased a medium drink from an Arby’s restaurant in Austin. Imagine my shock when I looked at the drink cup and saw a black and white picture of me printed on it next to the words “HAPPINESS IS JUST A CURLY FRY AWAY.” Here is a photograph I took of the actual cup in question:

I don’t know who gave you permission to print my image on your medium sized cups, but I would like to tell you here and now that I never approved anyone to do so, nor should any agent be acting as my proxy to give you consent to do this. Make no mistake about this – you are using my headshot on your medium cups (and I’m not sure where else) without paying me for it. What makes you think you have the right to do such a thing? Needless to say, I don’t like this one bit. Unlike my smiling mug on your cups, lava is shooting out of my ears right now because I’m so angry over this.

Since I have not agreed to have my picture used in this fashion, I’m sure you know that this is a major liability and it should be of major concern for everyone involved. Consequently, I would like to know how Arby’s Restaurant Group plans to remedy this situation. Additionally, I need to know is how long Arby’s has been using my image on their packaging and elsewhere. How many copies of my picture have been printed? Where, when, and from who did Arby’s obtain my photograph? I need answers to these questions in writing ASAP.
